This placement on tribal land means the casino operates under specific sovereign regulations that differ from state-level gaming laws. This unique governance framework provides a distinct operational context, allowing the Pueblo to manage and benefit directly from the resort's activities. The surrounding landscape of northern New Mexico also adds to the resort's allure, offering scenic views and a tranquil backdrop to the excitement within.

The regulatory framework governing Ohkay Casino Resort is rooted in the Indian Gaming Regulatory Act (IGRA) of 1988, a federal law that established the regulatory structure for gaming on Native American lands. Under IGRA, tribal governments can operate gaming facilities as a means of economic development and self-sufficiency. The New Mexico Gaming Control Board also plays a role in overseeing compacts between the state and tribal nations, ensuring compliance and fair operation. This dual layer of oversight ensures transparency, accountability, and the integrity of all gaming operations at Ohkay Casino Resort, reflecting a commitment to both tribal sovereignty and responsible management.
